The Ultimate Golf Membership Agreement

This Membership Agreement (“Agreement”) is entered into on [DATE] between [The Ultimate Golf Membership], hereinafter referred to as “The Company,” and the undersigned individual, hereinafter referred to as the “Member.”

By signing this Agreement, the Member acknowledges that they have read, understood, and agree to the following terms and conditions for The Ultimate Golf Membership.

1. Membership Benefits

The Ultimate Golf Membership includes the following benefits:

Unlimited Access: The Member is entitled to unlimited access to The Company’s golf simulators during regular business hours, subject to availability and any reservation requirements.
Discounts: The Member will receive [X]% off on pro shop merchandise, food and beverages, and additional services such as lessons or events hosted by The Company.
Exclusive Events: The Member will have access to exclusive member-only events, tournaments, and promotions.
Priority Booking: The Member will have priority when booking simulator time and lessons over non-members.
Guest Passes: The Member will receive [X] guest passes per month, allowing them to bring a non-member to use the simulators at no extra charge.
Training Sessions: The Member will receive [X] complimentary coaching or training sessions per [month/year], subject to scheduling availability.

2. Membership Fees

The Member agrees to pay the following fees for The Ultimate Golf Membership:

Initiation Fee (if applicable): A one-time initiation fee of $[AMOUNT] is due at the time of enrollment.
Monthly/Annual Dues: Membership dues are $[AMOUNT] per [month/year], payable on the [X] day of each month/year. Payments will be made automatically via the payment method provided by the Member (e.g., credit card, bank transfer).
Late Fees: Any dues not paid within [X] days of the due date may incur a late fee of $[AMOUNT]. The Company reserves the right to suspend or cancel membership privileges until outstanding payments are made.

3. Term & Renewal

Term: The term of this Agreement shall be for [1 year/6 months/other specified period], beginning on the date this Agreement is signed.
Automatic Renewal: This Agreement will automatically renew for successive terms of [1 year/6 months/other specified period], unless the Member provides written notice of cancellation at least [X] days before the end of the current term.
Cancellation by Member: The Member may cancel their membership at any time by providing written notice to The Company. Membership will remain active until the end of the current billing cycle, and no refunds will be issued for partial months.
Cancellation by The Company: The Company reserves the right to terminate this Agreement and revoke membership privileges for any reason, including but not limited to non-payment, violation of this Agreement, or misconduct by the Member or their guests. In such cases, no refund will be provided.

4. Reservation Policy

Simulator Time Reservations: The Member may reserve simulator time up to [X] days in advance. Reservations can be made online, via phone, or in person at The Company’s premises.
Reservation Cancellations: The Member must cancel reservations at least [24/48] hours in advance to avoid any cancellation fees. Late cancellations or no-shows may result in a fee of $[AMOUNT].
Walk-ins: While the Member is welcome to use the simulators without a reservation, availability is not guaranteed. Priority will be given to those with reservations.

5. Guest Policy

Guest Access: The Member may bring guests to use the simulators. The number of guests per visit is limited to [X]. Guest access is subject to the availability of simulators and must not interfere with other members’ or customers’ access.
Guest Fees: Any guests exceeding the monthly guest pass limit will be charged a guest fee of $[AMOUNT] per session.
Member Responsibility: The Member is responsible for the conduct of their guests and agrees to ensure that their guests follow all rules and policies of The Company.

6. Member Responsibilities & Code of Conduct

The Member agrees to:

Follow Facility Rules: Comply with all posted rules, guidelines, and instructions provided by The Company’s staff.
Use Equipment Properly: Treat all equipment, facilities, and simulators with care. Any damage caused to the equipment or property through misuse or negligence will result in repair or replacement costs charged to the Member.
Respect Other Members: Behave respectfully towards other members, guests, and staff. Disruptive, abusive, or inappropriate behavior will not be tolerated and may result in termination of membership without refund.
Health & Safety: The Member affirms they are physically able to participate in simulator golf and any associated activities. The Member will promptly report any hazards, injuries, or unsafe conditions to The Company’s staff.

7. Suspension & Hold Policy

Temporary Holds: The Member may place their membership on hold for medical, travel, or personal reasons for up to [X] months per year. Written notice must be provided at least [X] days in advance. During this period, no membership fees will be charged, and no benefits will be accessible.
Reactivation: Membership will automatically reactivate after the hold period, and the Member will resume regular payments.

8. Liability Waiver & Indemnification

Assumption of Risk: The Member acknowledges that using golf simulators and related facilities involves inherent risks of physical injury and property damage. The Member assumes all risks associated with their use of the facilities.
Release of Liability: The Member agrees to release, waive, and discharge The Company, its owners, employees, agents, and affiliates from any and all claims, damages, or liabilities arising out of or related to the Member’s participation in activities at the facility, including but not limited to personal injury, property damage, or theft.
Indemnification: The Member agrees to indemnify and hold harmless The Company from any claims, damages, or expenses resulting from the Member’s or their guest’s actions, including misuse of equipment or violation of this Agreement.

9. Photography & Media Release

The Member grants The Company permission to use photographs, videos, or other media taken during their use of the facilities for promotional purposes, including but not limited to social media, advertisements, and marketing materials. The Member agrees that no compensation will be provided for such use.

10. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the state of [STATE]. Any disputes arising out of this Agreement shall be resolved through arbitration in [CITY, STATE], and both parties agree to waive their right to pursue any claims through class action.

11. Entire Agreement

This Agreement constitutes the entire agreement between the Member and The Company regarding The Ultimate Golf Membership. Any amendments to this Agreement must be in writing and signed by both parties.
